E-commerce Service Agreement
I. General Provisions
Article 1
This Agreement is formulated to regulate the service behavior of the e-commerce platform (hereinafter referred to as the “Platform”), protect the legitimate rights and interests of users, and clarify the rights and obligations between the Platform and users.
Article 2
This Agreement applies to all users who register for and use the Platform’s services (hereinafter referred to as “Users”). By registering for and using the Platform’s services, Users are deemed to have fully read, understood, and agreed to all the terms of this Agreement.
Article 3
When using the Platform’s services, Users shall comply with applicable laws, administrative regulations, departmental rules, and relevant policies, as well as all provisions of this Agreement. The Platform shall provide services to Users in accordance with this Agreement and applicable laws and regulations.
II. User Registration and Account Management
Article 4
When registering, Users shall provide true, accurate, and complete personal information, including but not limited to name, mobile phone number, and email address. If such information changes, Users shall promptly update it on the Platform. Any consequences arising from false information or failure to update information in a timely manner shall be borne by the User.
Article 5
Upon successful registration, Users will obtain a Platform account and corresponding password. Users shall properly safeguard their account and password and shall be responsible for all actions conducted through their account and any resulting consequences. If any unauthorized use or security risk is detected, Users shall immediately notify the Platform and take appropriate security measures.
Article 6
The Platform has a duty to keep Users’ account information confidential and shall not disclose such information to any third party without the User’s consent, except as otherwise provided by laws and regulations or required by competent authorities.
Article 7
Users shall not transfer, lease, lend, or use their accounts for any illegal activities. In case of violation, the Platform reserves the right to suspend or terminate the account and hold the User liable.
III. Product Transactions
Article 8
The product information displayed on the Platform (including but not limited to price, specifications, origin, and usage) is for reference only. Users shall carefully verify product details before placing an order. In case of errors in product information, the Platform will make reasonable efforts to resolve the issue but shall not bear corresponding liability.
Article 9
Once a User places an order on the Platform, it shall be deemed that an order has been created. The Platform will confirm the order within a reasonable time after receipt. If there is any error in the order information or the product is out of stock, the Platform reserves the right to refuse order confirmation and will promptly notify the User.
Article 10
Users shall make payment in accordance with the Platform’s prescribed payment methods in a timely manner. Orders will be automatically canceled if payment is not completed on time.
Article 11
The Platform will ship products according to the order details and the delivery address specified by the User. Upon receipt, Users shall carefully check the quantity, specifications, and condition of the goods. If there are any discrepancies, Users shall raise them immediately with the delivery personnel and notify the Platform in a timely manner. If objections are raised after acceptance, the Platform will handle them based on the specific circumstances.
IV. After-Sales Service
Article 12
If Users request returns or exchanges, such requests must meet the Platform’s return and exchange conditions and be submitted within the specified period. Returned or exchanged goods must be in good condition, suitable for resale, and include all relevant accessories, manuals, and warranty cards.
Article 13
For eligible returns or exchanges, Users shall follow the Platform’s prescribed procedures. After receiving and verifying the returned goods, the Platform will process refunds or exchanges within a reasonable time.
Article 14
If a product has quality issues, Users may submit claims to the Platform with relevant proof. The Platform will handle such claims in accordance with applicable laws and regulations and its internal policies.
V. Privacy Protection
Article 15
The Platform attaches great importance to the protection of Users’ privacy and will collect, use, store, and protect Users’ personal information in strict accordance with applicable laws, regulations, and this Agreement.
Article 16
The Platform collects Users’ personal information solely for the purpose of providing services, including but not limited to registration, order processing, and after-sales services. Without User consent, the Platform shall not disclose such information to any third party, except as otherwise provided by laws and regulations.
Article 17
The Platform will adopt reasonable security measures to protect Users’ personal information from disclosure, loss, or alteration. However, the Platform shall not be liable for any disclosure caused by force majeure, hacker attacks, or other reasons beyond its control.
VI. Liability for Breach
Article 18
If a User breaches this Agreement, the Platform reserves the right to take measures such as warnings, suspension of services, or account termination depending on the severity of the breach, and to require the User to bear corresponding liability for damages.
Article 19
If the Platform breaches this Agreement and causes losses to Users, it shall bear corresponding liability. However, the Platform shall not be liable for losses caused by force majeure or the User’s own actions.
VII. Modification and Termination of the Agreement
Article 20
The Platform reserves the right to modify or supplement this Agreement based on business development and changes in laws and regulations. The revised Agreement will be published on the Platform’s website and will take effect upon expiration of the notice period. If Users disagree with the revised Agreement, they may stop using the Platform’s services; continued use shall be deemed acceptance.
Article 21
Unless otherwise provided in this Agreement, either party wishing to terminate this Agreement shall notify the other party in advance and complete the relevant procedures in accordance with applicable rules.
VIII. Dispute Resolution
Article 22
Any disputes arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with the competent people’s court at the location of the Platform.
IX. Miscellaneous
Article 23
This Agreement shall take effect from the date the User successfully registers and begins using the Platform’s services.
Article 24
If any provision of this Agreement is deemed invalid or unenforceable, it shall not affect the validity of the remaining provisions.
